Copyright Board resets television retransmission payment deadline

In 2026 CB 9, the Copyright Board approved a revised television retransmission tariff after an appellate remittal. The decision changes settlement and recordkeeping terms without reconsidering the underlying royalty rates.

A dispute over payment timing returned the 2014 to 2018 television retransmission tariff to the Copyright Board. In 2026 CB 9, dated September 25, 2026, the Board set the settlement date at 60 days after issuance of the revised tariff.

The Board also considered audit and recordkeeping duties. Those requirements could extend to December 31, 2027, but only for records still existing when the revised tariff was issued. Records lawfully destroyed before then couldn't be recreated.

The remittal wasn't a new hearing on royalty rates. For retransmitters and collecting societies, the decision instead determines when payment falls due and which records remain available to verify it.
