The timing of a royalty payment can have consequences independent of the amount owed. In Bell Canada v. Copyright Collective of Canada, 2026 FCA 107, the Federal Court of Appeal considered a Copyright Board decision setting a retroactive settlement date.
The appeal court found that the date wasn't adequately explained. Earlier appellate directions hadn't settled that question or prevented the Board from reconsidering related transitional provisions. It set those provisions aside and returned the issues for a fresh determination.
The appeal did not reopen the underlying royalty rates. Its significance is narrower and practical, since payment dates and transition rules can affect both retransmitters and copyright collectives.
