BC appeal court gives physician another chance to amend civil claims

The BC Court of Appeal allowed a physician to seek permission to replead certain civil allegations against a regulator and health authority, without deciding whether either institution was liable.

The British Columbia Court of Appeal has allowed a physician another opportunity to apply to amend his civil claim concerning the conduct of a professional regulator and a regional health authority. In Afridi v. College of Physicians and Surgeons of British Columbia, 2026 BCCA 378, the court found the chambers judge applied too demanding a standard when refusing a further amendment and gave insufficient consideration to the proper abuse of process analysis. The ruling doesn't establish misfeasance in public office, negligence or breach of contract, and it doesn't decide a claim for employment compensation. It clarifies pleading procedure where potentially viable causes of action have been imperfectly framed.
