A creative agency buying insurance for AI-assisted work still needs to decide what information its staff can put into a tool and what they can publish. Two developments in 2026 make that review more concrete. An insurer has clarified how its media policy responds when AI is involved, while a joint Canadian privacy investigation shows how the legal assessment can differ within Canada.
CFC announced that affirmative AI wording would enter its Media policy from July 30. According to the insurer, AI involvement in content creation doesn't itself prevent the policy from responding to defamation, intellectual property infringement and other media liability claims. It also described changes to cyber coverage. A business considering that product still needs the actual policy, territorial terms, exclusions and limits. The announcement doesn't establish that every AI loss is insured.
