The Ontario Court of Appeal restored the Licence Appeal Tribunal decision denying a late accident benefits claim. The insured had reported the collision and vehicle damage promptly but did not say he intended to claim accident benefits until much later. The Court held that the notice requirement in the Statutory Accident Benefits Schedule must be applied as written.
