Before the Policy Dispute, Check Who Was Licensed to Sell It

Insurance buyers often remember the price and the promise but not which legal entity issued the policy or who was authorized to sell it. Prince Edward Island's Superintendent of Insurance explains that insurers, agents and adjusters operating in the province must be licensed under its Insurance Act. The government also provides public licence lookups and encourages consumers to revisit coverage with an agent or insurer. Those are modest safeguards, but they become particularly useful when a claim exposes uncertainty about what was sold.

A licence establishes permission to carry on a regulated activity. It doesn't establish that a particular loss must be indemnified. Coverage still turns on the contract, applicable statutes, exclusions and proven circumstances. Consumers should therefore distinguish a concern about an intermediary's authority or conduct from a dispute about the insurer's interpretation of a policy. The evidence required for each complaint will be different.

PEI's complaint guidance describes a sequence involving the insurer's internal process and relevant ombudservices. It makes clear that the Superintendent cannot order the settlement of an individual insurance claim. Where the complaint concerns representations by an agent, preserve emails, quotations, application materials and the policy as issued. If the disagreement is about the treatment of a claim, preserve the reasons for denial and the evidence supplied. The information can help narrow a regulatory question even if the underlying indemnity dispute must be determined elsewhere.

Businesses should also review renewal responsibility. A broker relationship that worked for years may change when a new location, new use of property or new class of employees is involved. Asking who is licensed and who supplied an assurance is not an accusation. It is a way of knowing where accountability begins. None of these checks can replace a careful reading of the issued insurance wording.
