Shah v. Post 83 Cooperative Housing Association, 2026 BCCRT 1482

The BC Civil Resolution Tribunal found that a housing cooperative unfairly prejudiced a member by requesting income documents without clearly explaining its separate internal subsidy, who qualified or how to apply. Writing “maximum” on a form couldn't waive an undisclosed benefit, so the cooperative was ordered to calculate and pay the subsidy he would have received, showing why boards must give meaningful notice of member entitlements.

Garry Point Housing Cooperative v O’Rourke, 2026 BCSC 1342

The BC Supreme Court granted a housing cooperative possession after its board corrected an earlier procedural fairness failure by giving an occupant a genuine opportunity to apply for membership and then reasonably refusing his incomplete application without the required credit check. Fair reconsideration did not oblige the board to waive neutral financial criteria, and a proposed arrears payment plan did not extinguish more than $54,000 in housing charges.

Pacific Park Place (1985) Housing Co-Operative v Tchaikoun, 2026 BCSC 1924

The BC Supreme Court refused to enforce a housing cooperative’s membership termination because the board hadn't made reasonable efforts to ensure the members knew about and could participate in the termination hearing. The court dismissed the cooperative’s application for possession, emphasizing that formal notice alone doesn't satisfy natural justice when someone risks losing their home.

Kyba v. The Owners, Strata Plan VIS 3743, 2026 BCCRT 1486

A strata owner challenged committee changes, hybrid AGM procedures, council conflicts and disclosure of meeting minutes, but couldn't establish significant unfairness. The CRT dismissed the claims it could hear and refused jurisdiction over certain contract-related conflicts.

Rossum v. The Owners, Strata Plan KAS1840, 2026 BCCRT 1477

A strata charged a half-entitlement lot full strata fees for years, but the tribunal limited reimbursement to the most recent two years of monthly payments. The owners received $1,808.84 plus interest, not their full $9,961.60 claim.

Decision 2026-10-19 · Open coverage

Doerksen v. The Owners, Strata Plan EPS7290, 2026 BCCRT 1479

A strata proved that an owner dumped garbage in a parkade but lost one $200 fine because its notice cited a bylaw that didn't apply. A second $200 fine survived because the notice correctly identified prohibited use of a drive aisle.

Decision 2026-10-20 · Open coverage

Stelzer v. The Owners, Strata Plan VR2699, 2026 BCCRT 1493

A small strata validly approved limited common property for an owner's patio by a 3 to 1 vote, curing an earlier informal exclusive use. The opposing owners couldn't establish significant unfairness merely because they lost the vote.

Decision 2026-10-20 · Open coverage

Nagel v. The Owners, Strata Plan EPS1553, 2026 BCCRT 1492

A strata avoided a $35,000 claim for mould and interior repairs because it reasonably pursued lasting exterior wall repairs, financing and roof access before implementing an interim remedy. The presence of real mould didn't itself establish negligence.

Decision 2026-10-20 · Open coverage

Wright v. The Owners, Strata Plan EPS1553, 2026 BCCRT 1491

A strata wasn't liable for nearly $28,000 in internal water damage even though exterior repairs took years. The Tribunal found the council reasonably investigated competing remedies and faced difficult access and financing constraints.

Decision 2026-10-20 · Open coverage

Purcell v. The Owners, Strata Plan PGS173, 2026 BCCRT 1490

A strata's temporary repair of a leaking window and measured response to reported attic moisture satisfied its maintenance duties on the evidence. The owner couldn't dictate a particular fix or establish that an immediate attic inspection was required.
