Union allowed to pursue specific performance of pension agreement

The BC Court of Appeal allowed the union to amend its claim and pursue specific performance of a pension agreement. Asking for damages earlier did not clearly amount to an irreversible choice to accept the employer’s alleged repudiation of the agreement.
