Proving Negligence Without Physical Evidence

A fire ignited on the rear deck of a residential property on 8th Avenue in Clearwater Crossing, Alberta, in early May 2023, then spread west through sustained 35 km/h winds to consume 3 adjacent homes before exhausting itself. The local volunteer brigade was deployed to regional wildfires and could not respond.

Four negligence theories emerged against the property owner: an unattended barbecue, an unattended smoker appliance, improperly discarded cigarette materials, and an electrical fault from a travel trailer connected to an outdoor receptacle. Yet the structure burned to its foundation, leaving only concrete and metal remnants. Forensic examination found the barbecue and smoker in the debris but could draw no ignition conclusions. Meteorological analysis confirmed that ember transport from a wildfire 30 kilometres upwind was physically impossible given prevailing easterly winds. Each hypothesis remains equally speculative, and none crosses the balance-of-probabilities threshold required to establish causation.
