Québec's labour tribunal found that new minimum childcare services rules unjustifiably restricted workers' freedom of association. Its constitutional declaration applied only to the parties.

Source reviewed · Court holding

Held. Québec's labour tribunal found that new minimum childcare services rules unjustifiably restricted workers' freedom of association.

A childcare centre sought minimum services during a strike under Québec's new population wellbeing provisions. A panel of three labour tribunal members found that the regime substantially impaired collective bargaining and the right to strike. The restriction wasn't justified, and two interim service orders were revoked.

Why it matters. Sections 111.22.3 to 111.22.16 were declared inoperative for these parties. The tribunal didn't repeal the provisions across Québec.
