Manitoba extends its new sick note rules beyond the usual employment standards coverage

A regulation effective October 1 makes Manitoba’s new sick note division apply to specified workers who remain outside much of Part 2, including certain household workers and regulated professionals.

Manitoba's new sick note rules came into force on October 1, but Regulation 106/2026 does something more specific than repeat the new thresholds. It changes who those rules reach. The underlying legislation limits when an employer may require a sick note for a short absence caused by injury or illness. An employer generally cannot require one unless the absence continues for more than one week or the employee has been absent because of injury or illness on more than 10 scheduled workdays in the same calendar year. The legislation also broadens who can issue a sick note and requires an employer to reimburse the employee for the cost when a note is required. Regulation 106/2026 deals with a different question. Manitoba's Employment Standards Regulation excludes some categories of employees from much of Part 2 of the Employment Standards Code. The October amendment adds the new sick note division to the list of provisions that still apply to two of those categories. The first group is certain people working in an employer's private residence.
