Regulatory Update

Manitoba workplaces now have to provide menstrual products at no cost

Since September 1, Manitoba employers must provide pads and tampons at no cost in worker washrooms or, where that is not reasonably practicable, in another private and accessible workplace location.

Manitoba employers have had a new workplace supply obligation since September 1, 2026. Pads and tampons must be available to workers at no cost, generally in washrooms used by workers. The rule also requires a covered disposal container near each toilet. The requirement is simple enough that it could be mistaken for a facilities detail and handed off without much thought. It is still an employment and workplace health issue. A policy can be legally correct on paper and fail in practice if products are routinely empty, stored somewhere workers have to ask for them or placed in a location that is technically accessible but not private. Manitoba’s regulation recognizes that not every workplace can stock products inside every washroom. Where that is not reasonably practicable, an employer can provide them somewhere else at the workplace. That alternative location has to be accessible to workers at all times and offer a reasonable amount of privacy. The province’s guidance goes further in explaining the practical expectation.
