Ontario job ads must now disclose pay, AI screening and whether a vacancy exists

The 2026 rules generally apply to employers with at least 25 employees and also prohibit Canadian-experience requirements in public job postings.

The new posting standard

Since January 1, 2026, covered Ontario employers must include expected compensation or a compensation range in publicly advertised job postings. A stated range cannot span more than $50,000, although the disclosure requirement does not apply where expected annual compensation exceeds $200,000 or the top of the range exceeds that amount.

A posting must also say whether an existing vacancy is available and disclose whether artificial intelligence is used to screen, assess or select applicants. Canadian-experience requirements are prohibited in the posting and its associated application form.

Scope

The employer rules generally apply when the organization has at least 25 employees on the posting date. Employers remain responsible when a recruiter or third-party platform carries the advertisement. Interviewed applicants must also be told within the prescribed period whether a hiring decision has been made.
