Stewart v. Elk Valley Coal Corp.

What happened

The Supreme Court considered an Alberta mine's drug and alcohol policy after an employee tested positive following an accident. The majority upheld the human-rights tribunal's conclusion that the employee was terminated for breaching the policy rather than because of his addiction, so prima facie discrimination was not established on the tribunal's findings.
