Regulatory Update

Québec workplace prevention now depends on evidence of implementation

CNESST's current guidance distinguishes a prevention document from the continuing work of applying it, involving workers and checking whether controls work.

Québec's workplace prevention framework reaches into the daily operation of small establishments. The regulation that took effect on October 1, 2025 addresses prevention programs, action plans and worker participation. CNESST's current guidance makes implementation an employer responsibility, including training and checks on the controls chosen for the workplace. Establishments with 19 workers or fewer generally need an action plan. CNESST identifies exceptions requiring a prevention program, including certain establishments covered by a multiestablishment arrangement, a mutuelle de prévention or a specific CNESST requirement. The employer develops the plan with workers and the health and safety liaison officer, then updates it annually. A generic document that doesn't reflect the establishment's risks misses the purpose of that process. For establishments with 20 workers or more, CNESST describes a prevention program that must be developed, applied and updated annually. A drop below that threshold doesn't necessarily end the program.
